Terms and Conditions
These Terms and Conditions govern access to the AVBOX US website and purchases of aircraft hardware, aircraft parts, electrical components, avionics, specialized aviation tools, and related products.
Agreement to These Terms
These Terms and Conditions (“Terms”) form an agreement between you and AVBOX US (“AVBOX US,” “we,” “us,” or “our”). They apply when you use our website, create an account, request information, submit a purchase order, place an online order, or purchase a product.
By using the website or placing an order, you agree to these Terms, our Privacy Policy, Refund and Returns Policy, and Shipping and Ordering Information. If you act for a company or organization, you represent that you are authorized to accept these Terms for it.
Aviation Products Require Independent Verification
AVBOX US provides product information to support purchasing review. We do not determine whether a product is airworthy, approved, eligible, or suitable for installation on a particular aircraft, engine, propeller, appliance, system, or component.
- The purchaser and installer must verify part number, configuration, condition, documentation, effectivity, and installation eligibility.
- Photographs, dimensions, alternates, and cross-references are not installation approvals.
- Only qualified and appropriately authorized personnel should approve installation or return to service.
1. Eligibility, Accounts, and Customer Information
You must be legally able to enter into a binding agreement. You are responsible for providing complete and accurate account, billing, shipping, tax, payment, export, and contact information and for safeguarding your login credentials.
We may suspend an account, refuse service, or cancel an order when reasonably necessary to address fraud, security concerns, abusive behavior, payment issues, inaccurate information, export restrictions, sanctions, or violations of these Terms.
2. Product Information and Availability
We make reasonable efforts to describe products accurately. Listings may include part numbers, alternate numbers, condition, quantity, unit of sale, photographs, dimensions, markings, packaging, documentation, and other available information.
- Photographs: Packaging, labels, finish, markings, and cosmetic appearance may vary unless the listing states otherwise.
- Inventory: Displaying a product does not guarantee availability or order acceptance.
- Units of sale: Confirm whether an item is sold by each, foot, pound, lot, pack, pair, or another stated unit.
- Errors: We may correct pricing, inventory, categorization, typographical, or technical-data errors before shipment.
3. Condition and Documentation
Only the condition and documentation specifically shown or stated in the listing should be expected.
- A Company CoC is not a Manufacturer CoC.
- Trace is not automatically FAA Form 8130-3.
- Serviceable, As Removed, New Surplus, and other conditions must be reviewed individually.
- Confirm documentation requirements before ordering.
4. Alternates and Interchangeability
Alternate, superseded, or cross-referenced numbers are research information and are not automatic installation authorization.
- Similar specifications do not necessarily establish interchangeability.
- Supersession may be one-way or conditional.
- Aircraft model, serial number, effectivity, and modification status may matter.
5. Orders, Quotes, and Acceptance
An automated confirmation, quote, or payment authorization acknowledges receipt but does not necessarily constitute final acceptance. An order is accepted when AVBOX US confirms acceptance or ships the product, subject to applicable law.
We may request additional information or decline, limit, hold, or cancel an order because of inventory or pricing errors, payment problems, suspected fraud, address concerns, export restrictions, product restrictions, or inability to satisfy documentation or shipping requirements.
Customer purchase-order terms do not modify these Terms unless AVBOX US expressly agrees in a signed writing.
6. Pricing and Payment
Prices may change before order acceptance. You authorize AVBOX US and its payment providers to process applicable charges. We may require verification, cleared funds, or another payment method.
7. Taxes, Duties, and Fees
The customer is responsible for applicable taxes, duties, tariffs, brokerage, customs charges, bank fees, and government assessments unless expressly agreed otherwise. Valid tax-exemption documents must be supplied before exempt processing.
8. Shipping and Delivery
Shipping methods, processing estimates, carrier options, customer-account shipping, international delivery, freight, and special handling are governed by our Shipping and Ordering Information.
- Processing and transit estimates are not guaranteed delivery dates.
- The customer is responsible for accurate addresses and authorized carrier-account details.
- Address correction, refused delivery, storage, customs, and failed-delivery charges may be billed to the customer.
- Title and risk of loss transfer according to the applicable shipping terms, written quote, or controlling law.
9. Cancellations, Returns, and Refunds
Except when required by law or approved under our written policy, all sales are final. Returns are generally considered when AVBOX US shipped the wrong item, the item arrived damaged, or the product was materially not as described.
Customer ordering mistakes, fitment errors, changed requirements, unapproved substitutions, and changes of mind are not normally returnable. Special-order, custom, modified, programmed, calibrated, sourced, or cut-to-length products may not be cancelled or returned after processing begins.
All requests are governed by our Refund and Returns Policy. Do not return an item without written authorization.
10. Receiving Inspection
Inspect part numbers, quantities, condition, packaging, markings, and included documents promptly after delivery. Keep all packaging and do not install, modify, disassemble, or place a disputed item into service.
11. Damage and Shortage Claims
Report wrong, damaged, incomplete, or materially misdescribed shipments promptly and provide photographs, labels, packaging, the order number, and a clear description. Failure to preserve evidence may limit our ability to investigate.
12. Warranties and Disclaimers
When a transferable manufacturer warranty applies, the customer’s rights are governed by the manufacturer’s terms. AVBOX US does not create or extend a manufacturer warranty unless expressly stated in a signed writing.
To the fullest extent permitted by law, products and website content are provided “as is” and “as available”, subject to the condition and documentation expressly stated in the listing. AVBOX US disclaims implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and warranties arising from course of dealing or usage of trade, except where prohibited by law.
13. Limitation of Liability
To the fullest extent permitted by law, AVBOX US and its owners, employees, agents, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profit, revenue, use, data, business, goodwill, aircraft availability, mission capability, or production time.
To the fullest extent permitted by law, AVBOX US’s aggregate liability relating to a product or order will not exceed the amount paid to AVBOX US for the specific product giving rise to the claim. These limits do not apply where prohibited by law.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless AVBOX US and its owners, employees, agents, affiliates, and service providers from third-party claims arising from your misuse of the website or products, violation of these Terms or law, inaccurate information, unauthorized export, or installation or use contrary to approved data.
15. Export Controls and International Orders
Products, software, technical information, and documentation may be subject to United States export-control and sanctions laws. You agree not to export, re-export, transfer, release, or use any item in violation of applicable law.
You are responsible for destination-country import requirements, permits, end-use restrictions, taxes, duties, customs, brokerage, and carrier limitations. AVBOX US may request end-user or end-use information and may decline a transaction for compliance reasons.
16. Acceptable Website Use
- Do not interfere with website security or operation.
- Do not attempt unauthorized access or introduce malicious code.
- Do not scrape or reproduce substantial catalog data without permission.
- Do not submit false, fraudulent, abusive, or misleading information.
17. Intellectual Property
AVBOX US owns or licenses the website’s original branding, text, layout, graphics, databases, and guides. Manufacturer names, trademarks, and part numbers remain the property of their respective owners and are used for identification.
18. Third-Party Services
The website may use payment providers, carriers, analytics platforms, mapping services, and third-party links. AVBOX US does not control their availability, security, content, or policies.
19. Electronic Communications
You consent to receive transactional records electronically, including order confirmations, invoices, account notices, shipping messages, and policy notices. Marketing communications remain subject to applicable consent and opt-out rules.
20. General Legal Terms
Governing Law and Venue
These Terms are governed by Florida law, without regard to conflict-of-law principles. Unless applicable law requires otherwise, disputes will be brought in a court of competent jurisdiction in Escambia County, Florida.
Force Majeure
AVBOX US is not responsible for delays caused by circumstances beyond reasonable control, including carrier disruption, severe weather, natural disaster, government action, export restriction, cyberattack, utility failure, supplier interruption, labor dispute, or transportation shortage.
Severability and Waiver
If a provision is held unenforceable, the remaining provisions remain effective to the extent permitted by law. Failure to enforce a provision is not a waiver.
Entire Agreement
These Terms and incorporated policies govern website use and purchases unless a signed transaction-specific agreement expressly provides otherwise.
Changes
We may update these Terms by posting a revised version with a new “Last updated” date. Changes do not retroactively alter completed transactions except as required by law or agreed in writing.
